General Terms and Conditions of Sale ( GTC) for

1. Scope of Application

These General Terms and Conditions apply to all orders placed by customers in countries where delivery is offered and accepted at checkout, via the online shop operated by Zerokay Sports Sàrl, 330 route de Jussy, 1254 Jussy, Switzerland (hereafter “ZEROKAY”). 2. Offer and Contract Formation

2.1 The presentation of products on the website does not constitute a binding offer but an invitation to place an order.

2.2 By clicking the “Order” button, the Client submits a binding offer to purchase the listed products.

2.3 Immediately after the order is placed, a confirmation email is sent. The purchase contract comes into effect only once ZEROKAY confirms the shipment via email or, at the latest, upon delivery.

2.4 In the case of prepayment, the purchase contract is concluded upon confirmation of payment receipt.

3. Right of Withdrawal, Returns and Exchanges

3.1 Consumers are entitled to withdraw from the contract within 14 days of the delivery date, without stating a reason.
Delivery date means the date the parcel is first made available to the Client: either (i) the date it is delivered to the Client’s address, or (ii) if delivery is not possible and the parcel is redirected to a collection point, the date it becomes available for collection. This date is the one shown on the carrier tracking. Holds or extensions with the carrier do not extend the withdrawal period.
Please note: the right of withdrawal does not apply to personalised/custom ski helmets (see section 3.8)

3.2 To exercise this right, the Client must contact Zerokay Sports in advance (return request/notification) and return the goods to: Zerokay Sports, 330 route de Jussy, 1254 Jussy, Switzerland. Upon exercising the right of return, both parties must return the services or goods received. Return shipping costs are borne by the Client.

3.3 The purchase price will be refunded no later than 14 days after receipt of the returned goods. Outbound delivery fees paid by the Client will be refunded up to the amount of the cheapest standard delivery option offered by ZEROKAY. Any additional delivery charges selected by the Client (e.g., express shipping) are not refunded.

3.4 Condition of returned goods and deductions from refunds.
To be eligible for a refund, returned goods must be new, unused, and returned in their original condition, with all labels/tags intact and all accessories and packaging included. ZEROKAY reserves the right to refuse a refund or to deduct from the refund any loss in value resulting from use or handling not necessary for assessing the nature, condition, or functioning of the goods. If the returned goods show clear signs of wear, damage, impact, scratches, missing parts, or altered condition, no refund will be issued.

3.5 Refund timing and return shipment responsibility.

ZEROKAY may withhold the refund until the returned goods are received and inspected. ZEROKAY strongly recommends that returns are sent using a trackable and insured shipping method. The Client remains responsible for the return shipment until the goods are physically received by ZEROKAY. A tracking number or proof of shipment does not entitle the Client to a refund. If a return shipment is lost in transit, the Client must contact the carrier and file any claim; the refund will be issued only once the goods are received by ZEROKAY.

3.6 Undelivered parcels / Refused delivery / Returned to sender (RTS) — additional costs
ZEROKAY reserves the right to charge the Client for, or deduct from any refund, any additional costs incurred due to refusal, non-collection, incorrect/incomplete address, or failure to complete any required delivery/customs steps (including but not limited to return-to-sender fees, carrier fees, customs/handling fees and similar charges).

3.7 Reshipping after return due to Client
If a parcel is returned to ZEROKAY due to the Client (incorrect/incomplete address, refusal, or non-collection) and the Client still wishes to receive the order, the Client must pay the cost of reshipping (new shipping label) and any related costs.

3.8 The right of withdrawal is excluded for the following: Personalized/custom ski helmets. Personalised/custom ski helmets are made to order and cannot be returned or refunded.

3.9 Exchanges are not guaranteed and are subject to availability and prior return request. Sale/discounted items are not eligible for exchange.
For deliveries in Switzerland, ZEROKAY offers one (1) free size exchange per order, subject to availability and prior return request. Any additional exchange may be refused or will be processed at the Client’s expense (shipping and handling).
For deliveries outside Switzerland, no exchange is offered. The Client may return the item in accordance with this section and place a new order.

3.10 Unauthorised / Late Returns
Returns sent without prior return request or after the 14-day period are not accepted and will not be refunded. If ZEROKAY nevertheless receives such a parcel, the Client has 30 days from ZEROKAY’s notice to provide instructions and pay the cost of reshipping (and any reasonable handling/storage costs, if applicable). No refund is due in any case for unauthorised/late returns. After this period, the goods will be handled in accordance with applicable Swiss law.

4. Prices and Shipping Costs

4.1 Product prices are listed in Swiss Francs (CHF).

4.2 For international orders, prices are displayed without Swiss VAT. Import taxes and customs duties may be collected on delivery and remain the sole responsibility of the Client.

4.3 Shipping Costs

Domestic (Switzerland & Liechtenstein)

  • Economy: CHF 7 (approx. 2 business days). Free shipping from CHF 90 (automatically applied at checkout).

  • Priority: CHF 10 (approx. 1 business day).

  • Same-Day Delivery (Geneva only, order before 17:00): CHF 15 (delivered by 22:00; option appears at checkout if eligible).

  • Concierge service in Geneva (ski helmets): CHF 80 — free for orders from CHF 220. Booking required (please contact us).

International Shipping

  • Available delivery countries and shipping options are displayed at checkout and may change at any time.

  • Shipping fees and estimated delivery times are shown at checkout and detailed in our Shipping Policy.

  • Import taxes and duties for international orders may be collected on delivery and are the responsibility of the customer.

  • Shipping fees may depend on the shipping class of the items in the cart (as described in our Shipping Policy). For some destinations, the highest applicable shipping cost may apply for multiple items; for others, shipping fees may be calculated by adding the shipping fee of each item.

General Conditions

  • Delivery times are estimates and may be extended due to customs clearance and local postal/courier delays in the destination country.

  • Once parcels are handed to the courier, Zerokay is not responsible for loss, theft, or damage during transit.

5. Delivery Conditions

5.1 Deliveries are made to countries where delivery is offered and accepted at checkout (subject to availability at checkout).

5.2 Standard delivery time is approximately 1–2 business days for deliveries within Switzerland and the Principality of Liechtenstein (depending on the selected shipping method).

5.3 For international deliveries, the standard delivery time is approximately 3–10 business days, depending on the destination and subject to customs clearance.

5.4 Partial deliveries may occur without extra shipping fees. If delivery fails after three attempts due to the Client’s fault, Zerokay may cancel the contract and refund any payments made.

6. Payment Terms

6.1 Payments can be made via credit card or Twint.

6.2 Credit card payments are debited immediately. Twint payments are charged at the time of shipment.

6.3 Offsetting with unrecognized claims is excluded.

6.4 Retention rights are limited to claims under the same contract.

7. Retention of Title

ZEROKAY retains ownership until full payment is received. Goods may not be pledged, modified, or resold before full ownership transfer.

8. Product Descriptions and Availability

8.1 ZEROKAY endeavors to provide accurate descriptions of all products. Photos are illustrative and may differ from the actual item.

8.2 Availability is subject to stock. If a product becomes unavailable after order validation, the Client will be notified and fully refunded.

9. Personalized Ski Helmets

Clients may choose from predefined or custom colors. Final painted colors may vary. Orders typically take 30 business days and are non-refundable and non-exchangeable. Pantone or color systems are not used; color requests are approximated.

10. Product Warranty

10.1 ZEROKAY provides legal warranty for defective goods. The seller may choose between repair or replacement.

10.2 If repair fails, the Client may withdraw from the contract unless the defect is minor. Price reduction claims are excluded.

11. Liability

ZEROKAY excludes liability for slight negligence, including actions of auxiliaries and subcontractors.

12. Data Protection

ZEROKAY handles personal data in compliance with applicable laws. Information is used solely for order processing and delivery. Full details are provided in the Privacy Policy available on the website of Zerokay Sports Sàrl as well as by following the link.

13. Intellectual Property

All website content (texts, images, graphics, code) is the intellectual property of ZEROKAY and/or its suppliers. Any unauthorized use is prohibited.

14. Applicable Law and Jurisdiction

These GTC are governed by Swiss law, excluding international private law. Jurisdiction lies exclusively in Geneva, Switzerland. In case of discrepancies, the French version prevails.

15. Severability Clause

If any provision is found to be unlawful or unenforceable, the remaining provisions remain valid. The invalid provision will be replaced with a legally permissible one that best reflects the original intent.

16. Termination

Either party may terminate the contract in the event of substantial breach, insolvency, or service unavailability.

17. Changes to the GTC

ZEROKAY reserves the right to amend these GTC at any time. Changes take effect upon publication on the website.
